Definitions

Seller: Creative Conversions

Buyer: Any party who enters into a contract with the seller by which seller agrees to produce or assemble goods for the buyer

Price

Unless otherwise agreed to in writing by Creative or by the Creatives’ authorised representative, the price charged and payable for the Goods and/or Services shall be the price in Local Currency at the date that Creative accepts the Order, together with any applicable taxes, charges, and delivery costs in relation to the Goods and/or Services. Prices contained in any Quote or Order for the supply of Goods and/or Services are based on the cost prevailing and the specifications supplied at the time of the Quote or Order. Creative reserves the right to vary the price if: (a) there is any movement in the cost of supplying the Goods and/or Services specified in the Order; (b) if the Goods and/or Services specified in the Order are varied from the Goods and/or Services specified in the Quote, and Creative provides the Buyer with reasonable notice of any such variation of price.

Original Parts

Please advise at the time of placing your order -vehicle conversion/2nd stage of manufacture (job) if you wish to keep any parts from the original car (that are not used once conversion is completed). This includes seats, cab cut, wheels, tyres, and any other miscellaneous parts. Due to the volume of parts that Creative Conversions receive, we cannot keep and store these items. All parts must be collected from Creative Conversions Brendale at your expense within 7 days of commencement. We cannot hold, pack, ship, or strip parts.

Delivery

The Buyer shall pay all handling and delivery charges associated with the cost of the vehicle conversion/2nd stage of vehicle manufacture. Goods are to be picked up from Creative Conversion’s head office located in Brendale QLD by the buyer or their nominated carrier. If a delivery date is nominated, goods will be delivered to the buyer by the seller or the seller’s nominated carrier. The Seller shall take reasonable steps to dispatch the Goods and/or Services on or about that date. However, the Seller does not make any warranty or promises that the Goods and/or Services will be available on that date.

Production & Delivery Dates

A Production slot will be allocated per vehicle conversion/2nd stage of manufacture (job) when an order is placed, these dates are approximate, Creative Conversions will do everything to ensure dates are met. Creative Conversions shall have no liability to the Buyer for delay or default in delivery due to transportation delays, shortage of labour, materials, or tooling capacity, coronavirus that causes COVID-19 government shutdowns or delays or other similar causes any liability for penalties or other consequential damages of any kind beyond Creatives reasonable control.

Payment:

Unless otherwise agreed, payment terms shall be COD. The goods shall remain the property Creative Conversions and shall not be released to the Buyer until full payment (being cleared funds) of the goods is received. Buyer shall make no deduction without Seller’s written consent.

Cancellation/Deposit Policy

Conversion/2nd Stage Manufacture bookings are only confirmed upon confirmation of min $2000 deposit being received. This deposit is 100% refundable if you cancel your booking 1 Calendar month or longer before the commencement of your production date. If you cancel your booking after this period, the deposit is Non-refundable.

Warranty

Creative Conversions warrants that all goods modified by them will be free from defects in materials and workmanship under normal operating conditions for a period 12 months from completion of the vehicle. All warranty work is completed under a back to workshop agreement only with delivery to and collection from the seller being the responsibility of the buyer. Warranty excludes downtime expenses, loss of vehicle/equipment use, removal of extra components added to the vehicle after the completion of the conversions/2nd stage of manufacture, rental of any other vehicle or related equipment while repairs are in progress, or other incidental, consequential or special damages. Other Accessories fitted post the conversion/2nd stage manufacture process may need to be removed and refitted/or replaced at the buyer’s expense to allow warranty repairs. The cost of such removal/replacement is not included in our standard warranty terms and is the responsibility of the buyer. The warranty set forth above is inapplicable to and excludes any defect, damage, or malfunction resulting from (i) normal wear and tear, erosion, corrosion, (ii) misuse, negligence, or modification of the goods or any component by Buyer or its representative, (iii) repair service provided by third parties, (iv) third party components will be warranted under their manufacturers respective warranty terms and conditions (v) all OEM components not modified by the seller must be referred to the original manufacturer’s warranty terms and conditions (vi) any other cause outside Seller’s reasonable control. This warranty will be voided by installation of unauthorized components into Seller’s products. Replacement products may be refurbished or contain refurbished materials. Proof of purchase must be provided to us upon claiming of any warranty

Changes, Modification, Waiver

No change in specifications, drawings, order, or delivery for the goods may be made without the prior written consent of Seller or within 8 weeks of commencement of the job. These terms may be modified only in writing signed by an authorized representative of the Seller. Seller’s waiver of Buyer’s default defaults. Seller reserves the right of Buyer cost adjustment when initial under any term or conditions shall not constitute a waiver of any further quotation with Buyer/Seller confirmation of necessary change. Changes to the above stated scope of production of Buyer product represents a production alteration versus original works and/or product supply may incur additional charges and/or affect stated lead times
